Senate Hearing Shows Security Holes in Screening Process for Refugees

The Senate Judiciary Subcommittee on Immigration and the National Interest held a hearing yesterday to discuss Pres. Obama’s plan to increase the number of refugees to 110,000 next year, despite security risks that the vetting process presents. In the hearing Obama administration officials admitted that asylum seekers were granted refugee status in the U.S. solely on their own testimony and that refugees have been caught committing terrorism offenses in the U.S.
Pres. Obama reduced the refugee processing time from 18-24 months to just three months in order to reach his goal of bringing in 85,000 refugees in FY16 an increase from the annual admission of 70,000 refugees. Starting next month Pres. Obama said he would continue to increase the number of refugees admitted to 110,000 in FY17.
Last year FBI Director, James Comey, expressed concern that the U.S. does not have the ability to thoroughly screen the Syrian refugees for terrorist ties even through the lengthy 18-24-month process.
During the hearing Sen. Ted Cruz (R-Texas) asked DHS Director León Rodríguez, “Is it true or false that the testimony of the applicant alone can be sufficient for approval?” Rodríguez replied, “there are cases where the testimony is not necessarily corroborated by documents…I am acknowledging that, yes, testimony can be the basis for the grant of a refugee…”
In his opening statement Sen. Jeff Sessions (R-Ala.), Chairman of the Subcommittee on Immigration and The National Interest, noted that there are over 10,000 open terror investigations with at least one investigation opened in every state and that according to FBI Director, James Comey, it takes about 30 agents a week to monitor one terrorism suspect.
Sen. Sessions warned that, “the Director of National Intelligence, the Director of the Central Intelligence Agency, and the Secretary of Homeland Security have acknowledged that terrorists could infiltrate the refugee population. Their concerns are valid, as it is clear that terrorists have done so successfully in the past.”
Sen. David Vitter (R-La.) cited that fact that 18% of ISIS prosecutions in the U.S. have been of refugees or asylum seekers. Director Rodríguez confirmed that refugees have been caught committing terrorist activity in the U.S.

Which 'Sanctuary' bill is best?

f any good can come from the tragic shooting of a San Francisco woman earlier this month at the hands of a five-times deported illegal alien, it's that Congress may finally take action to punish sanctuary jurisdictions that protect illegal aliens, including the federal government which has been releasing criminal aliens onto the streets.
The response has gotten confusing because at least a dozen bills have been offered in recent weeks to end sanctuary jurisdictions. They have all earned varying levels of attention, with the one pushed by Fox News' Bill O'Reilly getting the most attention even though it's not the best bill.
The bills differ in scope and effectiveness, allowing House and Senate leaders to pick and choose the bill they want to move. If recent history serves as a lesson, House and Senate leaders will choose the weakest possible bill to move even though a large majority of American voters are furious and want criminal aliens removed from the United States.
THE BEST BILL THAT NUMBERSUSA SUPPORTS
NumbersUSA supports passage of the Davis-Oliver Act introduced by Alabama Sen. Jeff Sessions (S.1640) and South Carolina Congressman Trey Gowdy (H.R.1148). It's named after Michael Davis, Jr. and Danny Oliver, two California deputy sheriffs who were murdered by illegal aliens. Among many other things, the bill would:
  • Authorizes states and localities to enforce immigration laws (consistent with Federal law enforcement);
  • Gives states access to federal programs to identify inadmissible and deportable aliens, and requires states to provide DHS with information on apprehended aliens who are suspected to be inadmissible or deportable;
  • Directs DHS to provide grants to states to aid in the cost of enforcing immigration law;
  • Provides for federal custody of apprehended aliens upon request of a state or local authority, and compensation for related incarceration and transportation;
  • Directs DHS to continue and expand the Criminal Alien Program (identifies criminal aliens in correctional facilities, ensures they are not released, and removes them upon completion of their sentences). States that receive SCAAP funding must comply with the program;
  • Authorizes states and localities to hold an alien for an additional period following completion of the alien’s prison sentence to determine inadmissibility/deportability or issue a detainer;
  • Requires states and localities to notify the federal government of inadmissible and removable aliens and comply with federal information requests and detainers;
  • Denies federal law enforcement assistance to sanctuary jurisdictions;
  • Authorizes removal and denial of benefits to terrorists and gangs, and authorizes the denaturalization of terrorists;
  • Expands the criminal grounds of inadmissibility and deportability;
  • Revises and increases penalties for reentry of criminal offenders and those who reenter after repeated removal;
  • Adds criminal penalties for unlawful presence in the U.S;
  • Increases penalties for immigration fraud;
  • Revises and improves the student visa program;
  • Significantly improves and expands Immigration and Customs Enforcement (ICE) and provides all ICE enforcement agents and detention officers with arrest authority; and,
  • Defunds President Obama’s executive amnesties.
The Sessions-Gowdy bills would go beyond simply ending sanctuary cities through additional measures to increase public safety as a whole. They would strengthen the enforcement of federal immigration laws, end benefits for known terrorists, and prevent foreign citizens who pose a threat to public safety from entering the country in the first place.
BILLS ADDRESSING ONLY SANCTUARY CITIES
None of the other bills, including the so-called "Kate's Law" pushed by O'Reilly, would do as much to make our communities safer. But more importantly, none of them, except for the Sessions-Gowdy bills, address the federal government's sanctuary policies. Immigration and Customs Enforcement has released nearly 70,000 convicted criminal aliens over the last two years. Only the Sessions-Gowdy bills would end this federal complicity.
Both Presidential Hopefuls Sen. Ted Cruz (R-Texas) and Sen. Rand Paul (R-Ky.) have introduced sanctuary bills. The Cruz bill is similar to Kate's Law in that it would only imprison previously deported aliens that return to the U.S. It wouldn't require jurisdictions to notify ICE when they release criminal aliens from prison.
The Paul bill would only block funding to jurisdictions that don't cooperate with federal immigration agents, while allowing the federal government to continue its sanctuary policies.
Legislation has also been introduced by Rep. Scott Desjarlais (R-Tenn.), Rep. Duncan Hunter (R-Calif.), Rep. Lou Barletta (R-Penn.), Sen. David Vitter (R-La.), Sen. John McCain (R-Ariz.), and Sen. Jeff Flake (R-Ariz.), but all of these bills would only block funding to sanctuary jurisdictions without addressing the feds policies.
THE CLEAR ACT
The only bill that comes close to the effectiveness of the Davis-Oliver Act is Rep. Marsha Blackburn's (R-Tenn.) CLEAR Act. NumbersUSA has promoted this bill in past years, and it's still a good bill, but the Davis-Oliver Act is more thorough and incorporates almost all of the CLEAR Act's state and local enforcement provisions.
DAVIS-OLIVER BILL NEEDS MORE CO-SPONSORS
The Sessions version only has 5 cosponsors. The Gowdy version has more than 30 cosponsors and has already been approved by the House Judiciary Committee. Just this week, Reps. Dave Brat (R-Va.) and Lynn Jenkins (R-Kan.) added their names to the list of cosponsors, but both bills need a lot more support!
We have faxes posted to your Action Board urging your three Members of Congress to support the Davis-Oliver Act. Please send these faxes, and if you've already sent them, there's more you can do. Next Monday, please call your Members of Congress or contact them through Social Media. Let's do everything we can to help get the Davis-Oliver Act signed in to law!

Senators Pursue Legislation Preventing Illegal Aliens from Claiming EITC

A group of Senators led by Chuck Grassley of Iowa introduced a bill that would disallow the Earned Income Tax Credit (EITC) for illegal aliens given amnesty under the President’s November 2014 executive actions. “This tax credit is meant to help the working poor get into the workforce,” Grassley said. “It isn’t meant to benefit individuals who aren’t authorized to work in the United States.”
The Internal Revenue Service recently testified that when illegal aliens get Social Security Numbers under Obama’s executive amnesty, they will be able to claim the EITC under tax returns filed for the last three years.
The bill is intended to close a loophole created by a 2000 IRS interpretation that has the effect of allowing those receiving deferred action to qualify for a credit they were previously denied or otherwise ineligible for at the time. It would deny the credit to those receiving deferred action unless they were eligible to claim the credit for the year in question and were authorized to engage in employment in the United States for the entire taxable year. This rule would apply to the year in which they are granted deferred action and for all previous returns.
The non-partisan Joint Committee on Taxation estimated the bill will save $1.7 billion over ten years in payments that otherwise would have gone out. The actual amount of Earned Income Tax Credit payments going to those receiving deferred action could be much greater.
Co-sponsors of the legislation are Mike Enzi, R-Wyo., Mike Crapo, R-Idaho, Jim Inhofe, R-Okla., David Perdue, R-Ga., Tim Scott, R-S.C., Pat Roberts, R-Kan., Johnny Isakson, R-Ga., Jim Risch, R-Idaho, John Boozman, R-Ark., and John Cornyn, R-Tex.

A vote to fund the executive amnesty is a vote for the executive amnesty. That's the message Congress and the country needs to hear about the vote on House GOP spending bills that gave the White House the money it needs to implement it's executive amnesty!

The GOP leadership's spending package enables:
  • The IRS to use billions of tax dollars to issue tax credits to unlawfully amnestied aliens;
  • The Social Security Administration to use tax dollars to issue Social Security numbers to unlawfully amnestied aliens, qualifying them for benefits;
  • The Department of Health and Human Services to use tax dollars to enroll unlawfully amnestied aliens in Medicare; and
  • The Department of Justice to use tax dollars to defend the President's unconstitutional amnesty against court challenges.




This plan forces candidates who ran against President Obama's executive amnesty to break their campaign promises. Rep. Mick Mulvaney of South Carolina expressed the frustration many Members have to the AP: Having said we're going to do everything we can to stop this -- and then to do nothing to stop it -- really hurts.
Breitbart reports that the GOP leadership's plan is beatable and highlights many efforts (from NumbersUSA, Eagle Forum, Heritage, Laura Ingraham, and CIS) to replace it with a better strategy:
...pass a short-term Continuing Resolution rather than a long term omnibus, and include language blocking funding for Obamas amnesty in it. If outgoing Senate Majority Leader Harry Reid can muster the votes to strip that language from the bill, or if Obama vetoes it after Reid fails to garner the votes, then the conservatives want the House to pass a short term CR until the new Republican congress, with GOP reinforcements, is sworn in in January. At that point, they'll target Obamas amnesty funding before he can get the program off the ground..."

Mary Landrieu, a Democratic senator from Louisiana, disagrees with Gov. Bobby Jindal’s (R-LA) decision to sign lifesaving legislation into law. The Unsafe Abortion Protection Act, which was authored by a Democratic woman and had bipartisan support, could close three of the five abortion clinics left in the state by requiring abortionists to have admitting privileges at local hospitals and insisting that any facility performing more than five abortions has proper licensing.
marylandrieuThe bill would make an already unsafe procedure a little less dangerous. It’s common sense, really.
“This bill will give women the health and safety protections they deserve,” Jindal said.
Yet, Sen. Landrieu isn’t convinced. Here’s her contradictory response to the governor’s pro-life decision:
“Although I personally believe that life begins at conception, I believe the last place the government needs to be is in the church, in the doctor’s office or in the bedroom. And so even people who advocate for less government intrusion, like Gov. Jindal, get themselves in the most personal decisions a family could ever make. Some of the bills being passed around the country are just very intrusive to personal decisions and very harmful to women and girls, you know, to their physical health and life. It’s a shame… 20 weeks is not the norm for being able to live outside of a hospital.”


Landrieu may think she’s doing the right thing by feminist standards in opposing Gov. Jindal, but she fails to see the hypocrisy in her argument.
One word: Obamacare.

What, I ask, is more intrusive than the federal government wedging itself between a patient and his or her doctor? Landrieu has continually defended the president’s unpopular health care legislation. In December 2013, she criticized the poor rollout of the bill on WAFB TV, yet still had no problem with the confusing content present in 3,000 pages of pure bureaucracy.

“The Affordable Care Act, as I said, the bill itself has got very good concepts and yes, I would support it again.”
Landrieu also insisted that Jindal’s approval of the abortion laws were “troubling” and not in line with “serving the people of Louisiana. Is she aware that the Pelican State was named the most pro-life state in the country in January? Perhaps, like Texas gubernatorial candidate Wendy Davis, she is choosing to ignore her constituents’ passion for the unborn. Hopefully voters will keep that in mind and take a closer look at her GOP opponent Rep. Bill Cassidy come election time.

New FAIR Report Details How Obama has Systematically Dismantled Immigration Enforcement

Hardly a week goes by, it seems, without some sort of new announcement of a policy shift on immigration emanating from the White House or a cabinet department. Without exception, these announcements entail the unilateral relaxation of some immigration law or the lifting of some penalty for those who violate the law.



What has transpired over the past three-and-a-half years is not a series of insignificant tweaks, as the President and his minions have claimed, but a well thought-out strategy on the part of the Obama administration to implement radical changes to our immigration policy, while making an end-run around Congress. A new report by FAIR, President Obama’s Record of Dismantling Immigration Enforcement, details each step taken by the administration as it has curtailed most enforcement of our immigration laws, bestowed de facto amnesty on millions of illegal aliens, while wreaking vengeance on anyone who tried to get in their way.



The report, issued Tuesday, grabbed national attention as the lead story on the FoxNews.com website, accompanied by a FAIR op-ed. There are also some other hopeful signs that Congress is finally taking notice of the administration’s strategy to cut them out of the immigration policy decision-making loop. On Thursday, Senators Jeff Sessions (R-Ala.), Chuck Grassley (R-Iowa) and David Vitter (R-La.) will be joined by immigration law enforcement officials at a Capitol news conference to “reveal the administration’s sustained dismantling of border protection and enforcement.”



Perhaps, finally, Congress and the American public will begin to take notice of the Obama administration’s incremental strategy of non-enforcement and amnesty

Fax & Ask Your U.S. Senators to Close the Illegal Alien Child Credit Loophole!‏

A report that aired on local television station WTHR in Indianapolis highlights an income tax loophole that is allowing illegal aliens to receive massive refunds from the IRS at the expense of U.S. taxpayers. According to the report, illegal aliens are filing false returns, claiming their own children, nieces, and nephews who, in some cases, don't even live in the United States to receive the alternate child tax credit. The cost to taxpayers is $4.2 billion per year!







The House of Representatives has already passed legislation to close this loophole, now the Senate needs to act. Please fax the Senate and ask them to pass either Sen. Marco Rubio's S. 3083 or Sen. David Vitter's S. 95, both of which would end this practice and save American taxpayers billions of dollars each year.

Rep. Black Introduces Immigration Bill Targeting Obama Administration's Lawsuits

Rep. Black Introduces Immigration Bill Targeting Obama Administration's Lawsuits

Representative Diane Black (R-Tenn.) introduced H.R. 3842, a bill that would stop the Department of Justice and the Obama Administration from pursuing lawsuits against Arizona, South Carolina and Alabama over their state immigration enforcement laws.



"While the federal government and the Obama Administration have failed to take any action, individual states have put forth measures that give law enforcement the authority to address the alien populations in their states- only to see the Obama Administration slap them with politically motivated lawsuits," Rep Black told The Daily News Journal.



Rep. Black continutes, "My legislation uses Congress's power of the purse to deny Eric Holder and the Justice Department the ability to use taxpayer dollars to fund these lawsuits. Congress must support every state's right to enforce the law and protect their own citizens without fear of retribution from the federal government."



In 2010, the Department of Justice filed suit against Arizona to halt the state's immigration enforcement efforts. Since then, DOJ has entered into lawsuits against eight other states.



H.R. 3842 is a companion bill to a Senate measure, sponsored by Senators Jim DeMint (R-S.C.), David Vitter (R-La.) and Jeff Sessions (R-Ala.).



"It's absurd that the Obama Administration, which has failed to enforce the nation's immigration laws, is now stopping South Carolina, Alabama and Arizona from taking commonsense steps to protect citizens and uphold the law," said DeMint.

Louisiana Seeks to Ban Illegal Immigrants from Census Count

Suit Filed with Supreme Court




The state of Louisiana has filed a lawsuit directly with the U.S. Supreme Court that contends illegal immigrants should not be included in census totals used to apportion House seats.



Louisiana says 2010 census numbers include millions of people who are not permanent residents of any state, and Louisiana has lost a House seat as a result, SCOTUSblog reports. The Constitution’s requirement for a census refers only to people who have a permanent legal residence in the states, according to the suit.



The federal government will likely offer its views before the Supreme Court decides whether to allow the suit.

Louisiana Attorney General Buddy Caldwell issued a statement announcing the lawsuit, the New Orleans Times Picayune reports. He said states "with large numbers of illegal foreign nationals" picked up seats in Congress at the expense of Louisiana and other states with fewer such residents. He said the needed information is already included in 2010 census results and a new tally would not be needed.



The case is Louisiana v. Bryson.

Ask Senate to Pass Law to Stop Obama Lawsuits Against States‏

Those of you reading our homepage at www.alipac.us on a regular basis are already aware that the Obama administration is suing to stop the states of South Carolina, Alabama, and Arizona from enforcing illegal immigration laws. It is these states where ALIPAC activists have fought hard to pass strong legislation designed to curtail illegal immigration.



In several cases, other nations are asking to join the Obama administration's case against our states.



The Associated Press reported yesterday that "Sixteen Latin American and Caribbean nations have asked to join in the U.S. Department of Justice's lawsuit against South Carolina's new illegal immigration law, citing concerns for their citizens." The nations trying to prevent us from stopping illegal immigration along with Obama are Argentina, Bolivia, Brazil, Chile, Colombia, Costa Rica, Dominican Republic, Ecuador, El Salvador, Guatemala, Honduras, Nicaragua, Paraguay, Peru and Uruguay.



We expect the Obama administration to attack the states of Indiana, Georgia and Utah as well due to immigration enforcement laws our activists have helped to pass in these states!



The good news is that US Senators Jim DeMint (R-SC), David Vitter (R-LA), and Jeff Sessions (R-AL) have announced a plan to file a bill that would prohibit the Justice Department from filing these lawsuits to block state laws designed to stop illegal immigration.



Your help is needed right away! To the phones!



Step 1: Call Senators Demint (202) 224-6121, Vitter (202) 224-4623 and Sessions (202) 224-4124 to say "Thank you for standing up for Americans fighting to stop and reverse illegal immigration. I support your bill to stop the Obama administration from suing states that try to crack down on illegal immigration.



Step 2: Call your members of the US Senate and as many other senate offices as possible to say "I am calling/writing to ask Senator _______ to please support Senators Demint, Vitter, and Sessions in their efforts to pass a law to stop the Obama administration from suing states like South Carolina, Alabama, and Arizona. These states are trying to stop illegal immigration themeselves since our own federal government is not enforcing laws and is infact helping illegal aliens to take American jobs, taxpayer resources, and voting rights. Please support the Demint, Vitter, and Sessions law designed to stop these DOJ lawsuits."

STEALTH AMNESTY: GOP ATTEMPTS TO HINDER OBAMA'S ILLEGAL ALIEN AGENDA


House Judiciary Committee Chairman Lamar Smith (R-TX) yesterday introduced the Hinder the Administration’s Legalization Temptation (HALT) Act (H.R. 2497), legislation to prevent the Obama administration from abusing its authority to grant massive administrative amnesty to illegal immigrants.




Senator David Vitter (R-LA), Chairman of the U.S. Senate Border Security and Enforcement First Immigration Caucus, will introduce the companion in the Senate this week.



Over the course of the last year, the Obama administration has sought to circumvent Congress and use executive branch authority to allow illegal immigrants to remain in the United States. Last month, Administration officials caved to pressure from their liberal base and announced changes to Secure Communities, GOP lawmakers have stressed.

The Secure Communities program keeps neighborhoods safe by identifying illegal and criminal immigrants in police custody who have been arrested and fingerprinted, police officials told the Law Enforcement Examiner.



They claim the changes made by the Administration could open the door to allow millions of illegal and criminal immigrants avoid current immigration laws.



Specifically, the Director of U.S. Immigration and Customs Enforcement, issued two memos to agency officials on how to exercise “prosecutorial discretion,” such as granting deferred action, deciding whom to stop, question, arrest, or detain, and dismissing a removal proceeding. While this authority is justifiable when exercised responsibly, the Obama administration has made clear that it plans to use this authority recklessly.



“Congress has defeated amnesty for illegal immigrants several times in recent years but this has not stopped President Obama from trying a backdoor amnesty. Over the course of the last year, the Obama administration has ignored the will of Congress and the American people by using executive branch authority to allow illegal immigrants to remain in the U.S," said Congressman Smith.



Adding insult to injury, U.S. taxpayers finance the enormous number of court appeals filed by illegal immigrants -- through their taxpayer financed legal counsel -- deported for criminal convictions and fraudulent marriages, said leaders of an organization that represents police commanders.



The suspected pervasive corruption allows deportable aliens to evade hearings without consequences and permits more than 1 million removal orders to be ignored by the Obama Administration, claim officials from the National Association of Chiefs of Police.



“While this authority is justifiable when used responsibly, it’s clear this Administration plans not to use but to abuse these powers, warns Rep. Smith.



"If the President gets his way, millions of illegal immigrants will be allowed to legally live and work in the U.S. without a vote of Congress. That is why I have introduced the HALT Act, which will prevent the Obama administration from granting a massive administrative amnesty to illegal immigrants. The Obama administration should not pick and choose which laws it will enforce. Congress must put a halt to this administrative amnesty,” he said.



“The Obama administration has taken steps to pass their amnesty agenda through executive order and completely bypass Congress. In the Senate we’ve already rejected some attempts at granting amnesty for illegal aliens by defeating the DREAM Act in last year’s lame duck session," said Senator Vitter.



"The administration has now taken their amnesty push to new levels by attempting to give DHS officials and other agencies the ability to grant amnesty, which is exactly why we’re introducing the HALT Act. Awarding amnesty over the objections of Congress and the American people would be a slap in the face to taxpayers, and especially to legal immigrants,” he stated.
