Senator Scott Brown (R-Mass.) is once again attempting to bring his Irish guest worker bill up for a vote before the Senate leaves for recess. The legislation would amend the Immigration and Nationality Act to add the Republic of Ireland to the E-3 visa program. If passed, an additional 10,500 visas would be available to low-skilled workers from Ireland to compete for U.S. jobs. These two-year visas can be renewed indefinitely.







This is bad legislation that would bring in more foreign workers to compete against unemployed Americans. Please call your Republican U.S. Senators and ask them to do all they can to prevent S. 2005, Sen. Brown's Irish guest worker legislation from coming up for a vote.

DR. CAMAROTA CATCHES THE PRESIDENT WITH HIS ENGINEER STATS DOWN

DR. CAMAROTA CATCHES THE PRESIDENT



WITH HIS ENGINEER STATS DOWN



This morning, I sent you an email with the amazing video of an engineer's wife asking Pres. Obama why he is bringing in foreign engineers when American engineers like her husband can't find a job.



The President found the question "interesting" because "industry tells me that they don't have enough highly skilled engineers."



The White House sent out spokespersons to defend the President by talking about how not enough Americans are getting engineering degrees.



My immediate question was: How many Americans with engineering degrees don't have an engineering job?



Amazingly just this afternoon, Dr. Steve Camarota of the Center for Immigration Studies has published a report that answers the question.



We will talk more about the meaning of these stats in the webcast. But chew on the numbers.



U.S.-BORN INDIVIDUALS WITH ENGINEERING DEGREES (under age 66)

(based on most recent American Community Survey by the Obama Administration itself)



101,000 -- U.S. engineers looking for a job who can't find any work at all

244,000 -- U.S. engineers who have dropped completely out of the labor market

1,470,000 -- U.S. engineers who are working but no longer as engineers

1.8 million -- Total U.S.-born individuals under the age of 66 who have engineering degrees but don't have an engineering job



There is a lot to say about all those numbers. But one thing that can't be said is that the United States doesn't "have enough highly skilled engineers" among its own citizens.



These numbers were compiled by Pres. Obama's own staff. But he apparently never thought to check on the facts. He was perfectly willing -- just like most Republican leaders -- to simply take the word of the business elites with whom he hobnobs when they claim they have to have more foreign engineers.

Rep. Guinta said that Washington's lack of willingness to enforce immigration laws is the cause for more than 11 million illegal aliens residing in the United States. Here's Rep. Guinta's column:



You and I, our families and neighbors, face a common problem. Between seven and 20 million people currently live and work in the United States illegally. They don’t pay local, state or federal taxes, yet they place an additional burden on government services and severely strain limited revenue sources. Because they came here illegally, there was no chance to check them for a criminal background. Their children attend public schools, adding to classroom size and diverting scarce education dollars. These problems keep mounting as people keep coming here illegally.



I am not opposed to legal immigration. I’m a product of it, just like many of you are. My ancestors came here legally from overseas. But illegal immigration is something entirely different. The U.S. is a nation of laws. Illegal immigrants choose not to play by the rules, and then expect to receive all the privileges given to those who followed the law and now live here legally. That’s just not right.



But everyone doesn’t see it that way. The Obama Administration has taken steps designed to make it possible for more illegal immigrants to stay in our country. An executive order was issued last month to circumvent Congress and establish new priorities for deportation. The result: it’s now easier for illegal immigrants to remain in the U.S. and apply for work permits. Even more troubling, this creates a back door approach for granting amnesty.



Let me repeat what I have said many times before: I do not favor and I will never support any attempt to grant amnesty to illegal immigrants.



I recently joined more than 50 of my colleagues in signing a letter to President Obama, protesting his action. I am also a member of the Immigration Reform Caucus in Congress.



But my involvement doesn’t end there. I’m adding my name as a co-sponsor to H.R. 2497, the HALT (Hinder the Administration's Legalization Temptation Act. The HALT Act would prevent United States Customs and Immigration Services and Immigration and Customs Enforcement from granting parole for illegals who commit crimes; issuing work authorizations; extending voluntary departures; giving illegals temporary protection status; executing deferred actions (authorizing illegals to work in the U.S); and reverses the administration’s recent executive order authorizing the cancellation of the removal of illegal aliens from our country.



To put it in everyday language, the HALT Act would do just that: it would halt the Obama Administration’s efforts to get around the law and would require the USCIS and ICE to continue doing their jobs.



If Americans want to change the immigration process and revise the laws that regulate the status of people are who currently living in our country illegally, that’s one thing. But to do it by executive fiat is something else. It’s bad enough that millions of people who choose to ignore and flaunt the law are living within our borders; it’s worse that the executive branch of our government, which is charged with upholding the law, chooses to ignore them as well.



In the last few years, we have witnessed an overreach of power from Washington as the administration has ruled by regulation. Enough is enough! I was sent to Congress to make sure the federal government returns to operating within its proper parameters and serves the people rather than lording over them.



These two problems – illegal immigration and an overzealous federal government – intersect in a way that’s bad for everyone. The HALT Act is an important tool for addressing both problems at the same time. It makes sure your government continues deporting the people who flaunt and disobey the law, and it makes sure that the government stays within its proper limits while doing so, too.



As an American citizen, you have the right to expect nothing less.

Radio hosts and newspaper reporters the last few days have been asking me what I suggest Americans can do to counter the terrible anti-American-worker announcement by the Obama Administration that it basically won't deport illegal alien workers unless they are violent felons.



Is there any reason now that any NON-violent worker in the world should resist the urge to come to the U.S.?

We don't know yet exactly what Pres. Obama's people are going to do in giving out work permits to non-violent illegal aliens.



But regardless of what they do, the announcement last week sent a terribly dangerous signal to the non-violent workers of the rest of the world to begin a new mass illegal migration to the U.S.



The U.S. House of Representatives must act as soon as it returns in September to send a signal to stop this illegal stampede.



The boldest and most powerful signal it can send is to pass a national mandatory E-Verify bill that not only stops illegal aliens from getting jobs but forces employers to fire the illegal aliens already working for them.



With 22 million Americans who want a full-time job unable to find one, first the House and then the Senate this fall must tell the world that the scarce number of jobs in our country are reserved for

Americans. And that even if Pres. Obama persists in his "presence amnesty" that allows non-violent illegal aliens to remain here indefinitely, they will not be able to get and hold payroll jobs.



For three years, Congress has refused to help unemployed Americans by cutting the number of foreign workers.



Now, it has to act. If it doesn't, unemployed Americans face an even larger army of foreign-worker competition.

Guestworker/Offshoring Scandal Gets (a little) Media Attention

High tech companies use legal guest worker programs to displace American workers and eventually move many Americans' jobs overseas. Although this harmful practice that has cost hundreds of thousands of skilled Americans their jobs has been ongoing for more than 15 years, it has received scant attention in Washington D.C. or in the national media. Most Americans outside the high tech industry may be learning about this shocking practice for the first time. But because of testimony given at a recent House Subcommittee hearing on H-1b visas and a whistle-blower scandal from within one of the largest users of the H-1b program, Americans are about to become enlightened.







The Hearing







Rochester Institute of Technology Professor Ron Hira's Congressional testimony caught the attention of the New York Times which quoted Hira's claim that legal loopholes in guestworker programs like the H-1b and L-1 visa programs enabled employers to "to bring in cheaper foreign workers, with ordinary skills, who directly substitute for, rather than complement, workers in America." The Times went on to report that "four of the five biggest users of [the H-1b program] from 2007 and 2009 were Indian outsourcing companies" who - between the four of them alone - brought 22,766 guest workers into the U.S. during the height of the recession.







The Hindu, India's national newspaper, also covered the hearing, and quoted Professor Hira saying, “If the H-1b programme loopholes were closed, many of those jobs would have gone to Americans.”







Previous blogs (here and here) described how the chief attraction of these guest worker programs is access to younger, cheaper workers -- not special skills as the employers insist. The New York Times' reporting on the hearing includes testimony from a small, high tech business owner who told testified that "employers are using these visas to give away our knowledge" (more on that below).

The Scandal







Infosys - one of the top four Indian outsourcing companies mentioned above - is being sued by whistle blower Jack Palmer, who alleges that Infosys asked him to sign fraudulent B-1 visa invitation letters. The B-1 visa (also known as the "meeting" or "visitor" visa) prohibits the visa holder from being paid by a U.S. employer. Palmer says Infosys asked him to write letters indicating that guest workers were coming to the United States for meetings when, in fact, he knew they were taking jobs.







Infosys (which is also being sued for age discrimination) has remained comfortably under the U.S. media's radar, despite being a big story in India. One notable exception is the technology news site Computerworld, which has followed the story from the beginning.







Dan Rather Reports has also recently picked up on the Infosys scandal, and his in-depth reporting included guidelines Infosys sends to B-1 visa applicants in order to not get caught scamming the system. Infosys advises:











"Do not mention activities like implementation, design & testing" or consulting, "which sounds like work."





"Do not use words like work, activity, etc., in the invitation letter. DO NOT TELL THEM YOUR [sic] WORKING. Speak little English."









USCIS (the federal agency that oversees the B-1 program) says that B-1 visa holders are permitted to provide "limited professional services," which may be enough of a loophole for Infosys to claim it is acting within the law. If so, this case appears to back Professor Hira's claim that the main problem with high tech guest worker programs isn't fraud, but the legal loopholes that allow employers to "legally hire foreign workers at significantly lower pay than Americans."







Insourcing labor = Offshoring jobs?







In his Economic Policy Institute report, Professor Hira says high tech guest worker programs "are being used to speed up the off-shoring of high-wage, high tech jobs." High-tech-worker activist Donna Conroy explains in the Dan Rather Reports segment that incoming guest workers are known as "knowledge transfer teams." First, the guest worker comes in and gets trained for the job (sometimes by the American she is replacing). Then, when the knowledge has been "transferred," the company can ship the foreign worker, and her job, back overseas.
