Judicial Gerrymandering Slowed By Supremes

A very interesting post from http://www.empowertexans.com/   about the new congressional districts in Texas being redrawn so that the new seats favor the Democratic party in a Republican state. This follows this previous post about conservative media to contact about this issue. This follows this previous article about encouraging American energy independence. This is a key issue to prevent money from going to hostile countries such as Iran  and Venezuela. For more that you can do to get involved click HERE and you can read a very interesting book HERE!

Judicial Gerrymandering Slowed By Supremes

Posted  by Michael Quinn Sullivan

Late Friday afternoon the US Supreme Court issued a stay against the legislative and congressional maps drawn by a three-judge federal panel based in San Antonio. This action marks a big win by Texas Attorney General Greg Abbott against a new low in judicial activism. It also puts the 2012 primary election calendar in flux.

—Attorney General Greg Abbott

By issuing the stay against maps drawn by the federal judges, the Supreme Court clearly finds Mr. Abbott’s arguments persuasive and deserving of review. Mr. Abbott has argued that the maps were an overreach of the court’s authority. Frankly, and with all due respect to our attorney general, that might be an understatement.

While the state legislatures are charged with drawing the political boundaries of legislative and congressional districts based on census numbers, the 1964 Voting Rights Act placed several states, including Texas, under additional federal review to ensure the protection of minorities from past patterns of discrimination. Courts have, in the years since, made varying changes to correct certain, specific deficiencies in the maps crafted by the legislature.

In a statement Friday evening, Mr. Abbott said he “is committed to protecting the integrity of Texas’ elections by ensuring they are conducted based on legally constructed redistricting maps, and the Supreme Court’s decision today is an important step in that direction.”

When lawmakers met this spring, they took on the task of redrawing lines in keeping with the population. Yet they might as well have adopted a 1987 road map of Texas, for all the three-judge panel cared. The judges touched districts seemingly without regard to common sense, instead creating a map only Democratic partisans could (and did) cheer. Talk about judicial activism!

Mr. Abbott and the legislative leadership – including House Speaker Joe Straus – should be roundly applauded for standing against this federal intrusion by the three-judge panel. Liberal media apologists discounted the possibility of a stay; but the overreach by their friends clearly has prompted the Supreme Court to take a most unusual step.

Remember, the federal judges’ maps all but disenfranchised Texas voters by ignoring their will as expressed through the 2010 general election ballot box. Voters sent an historic conservative super-majority to the state House, which was apparently unimportant to the court’s majority. They ignored voters who tossed out liberal incumbents of various ethnic backgrounds in favor of conservative challengers of various ethnic backgrounds.

As evidenced by the (apparently inconvenient) results of the 2010 election, the voters have Texas have truly been looking past the color of candidates skin and into the content of their philosophical and ideological character. That’s apparently a terrifying prospect for liberals in a conservative state, so they counted on the courts to dictate election results through gerrymandered districts.

Looking ahead, we don’t know what this stay means for the primary election calendar. With the real possibility of new lines, that means some folks currently running won’t be eligible, and those currently not running might suddenly find new life. Incumbents paired by the court might find themselves now without a fellow incumbent against them. Voters whose districts were radically shifted into new territories may find more familiar ground.

Until the Supreme Court has a hearing on the issue in early January, we’ll all be stumbling in the dark.

Some will, no doubt, decry the real possibility of the primary elections for the legislature and US House being delayed. (The 2012 presidential, US Senate, statewide and local primaries could still be held March 6.)

Frankly, it is better for the legislative and congressional primaries to be delayed so we have legal and fair lines, than to have them on time with unfair, improper, judicially gerrymandered lines.

Federal judges shouldn’t be allowed to engineer maps to suit the whims of disgruntled partisans unable to win at the ballot box. Texas voters deserve to have their voices heard, lest we do irreparable damage to our form of government.

Your Help is Needed to Defeat RINOs‏

A very interesting post from http://www.petermorrisonreport.com/  about defeating RINOS in the next election particulary in an era of anti-Republican redistricting! This follows this post about mandated union laws. This follows this previous article about encouraging American energy independence. This is a key issue to prevent money from going to hostile countries such as Iran  and Venezuela. For more that you can do to get involved click HERE and you can read a very interesting book HERE!

Your Help is Needed to Defeat Texas RINOs‏

Summary of this week's report:

RINOs are the curse of the GOP, but, as hard as it is to believe
after two years of Tea Party activism, many key RINOs are still in
office and Joe Straus is still the Texas Speaker. Despite the
current redistricting turmoil, we need to organize to give the boot
to as many RINOs in Austin and DC as possible.

Full report:

In 2012, Texas conservatives need to focus our energies on removing
our own RINOs from office, and keeping them off the Republican
ticket, this coming election.

It's impossible to overstate how important this task is, on both
the state and the national levels. RINOs are poison to a
conservative agenda. There is little real difference between them
and Democrats, and once elected they use their power to sabotage
attempts to enact good conservative legislation. We've seen this
take place in Austin over and over. No matter how loudly
conservatives speak at the polls, and how good prospects for
conservative legislation look, the RINOs in the party often manage
to water good bills down, or block them altogether.

On top of this, activist federal judges have thrown the election
into complete turmoil by throwing out the new legislative district
maps recently drawn up in Austin, creating their own maps, and
ordering the state to follow them. This was in response to a
lawsuit claiming that the maps drawn up in Austin discriminated
against non-white voters, particularly Hispanics. The court found
in their favor and drew up new maps that were much more to their
liking, because they include more districts where Hispanics are a
majority. (You can compare the legislature's map and the court's
map by doing an internet search for Texas District Viewer.) Given
long established voting patterns, what this boils down to is that
the court has created several more solidly Democratic districts,
and eliminated some solidly Republican districts.

Attorney General Greg Abbott has filed an emergency appeal with the
US Supreme Court to put the enactment of this ruling on hold,
partly because Monday, November 28th was the first day a person who
intends to run for office could file paperwork for a place on the
ballot. When it's not even clear what districts will exist come
Election Day, it's pretty difficult to file the proper paperwork,
so everything is in flux right now. Hopefully common sense and
judicial restraint will prevail at the Supreme Court, and this
ruling will be put on hold, but that is by no means certain.
Furthermore, even if this ruling does wind up being eventually
overturned on appeal, the voting trends driven by huge population
growth among Hispanics in Texas virtually assure that the state
legislature and Congressional delegation will become increasingly
less Republican and more Democratic.

Given all these factors - the dim prospects of a truly conservative
presidential candidate, the state elections being up in the air,
and the massive demographic changes taking place in Texas, it's
imperative that we work harder than ever in 2012 to elect genuine
conservatives to the state house and to Congress. The 2010
elections demonstrated what we can do when we're truly motivated,
and we need to recapture that same level of energy and motivation
for the Republican primaries of 2012, which take place in early
March.

If a RINO currently represents your district in Austin or DC, or if
one is currently the favorite for the GOP nomination, start
organizing now to defeat him or her in the primary. Wherever there
are genuine conservative challengers, it's time to get behind them.
If there aren't currently any, it's time to recruit someone. If
you don't know of anyone else that might run, consider running
yourself! It's easy to think of reasons not to run or get involved,
but as Edmund Burke once said, "All that is necessary for evil to
triumph is for good men to do nothing."

Don't underestimate the impact you may have. All incumbents either
run unopposed or run scared. RINOs in particular know they have
betrayed their base and are scared of being called on it. Several
conservatives won in 2010 in the primary against well-funded
incumbents, like former RINO state representatives Tommy Merritt
and Delwin Jones. By running against someone, even if you lose,
you make them spend money, money that an unopposed incumbent can
use to prop up his fellow RINOs in other districts. If you lose
and do better than expected, you might still accomplish your goal.
Case in point: RINO Burt Solomons just announced he won't be
seeking re-election. Insiders I know report that this is because
he was shown to be weak in the 2010 primary when he squeaked by
with 53% of the vote against an opponent who spent a tiny amount of
money, and big money conservative donors were looking to run a very
strong race against him this year, so he chickened out. There's
nothing more humiliating for an incumbent than to lose in a primary
(and many of them are lazy from years in office with no serious
campaigns), so often fear of losing makes them quit, and you win by
default. This happened in 2010 when RINO Brian McCall decided not
to run after the Tea Party started organizing against him in 2009;
now that district is represented by a real conservative, Rep. Van
Taylor. Slowly but surely conservatives are removing the turncoats
who betrayed their constituents and elected Joe Straus as Speaker.

The Republican primary election date of March 6th is not very far
away at all. Right now, the candidate filing deadline is December
15th. That may change, depending on what happens in the courts.
In the next few weeks we'll have a definitive answer one way or
another on the redistricting map, so if your district is currently
in flux that should change soon. So keep an eye on the news, and
get ready to do battle this March with GOP sellouts!

If you have any specific questions about your district, such as
whether your incumbent deserves a challenger, feel free to email
in. I can find out if there is an existing challenger and help
connect you with some folks who can help you if you decide to run.

Judicial gerrymandering‏ in Texas

A very interesting post from http://www.empowertexans.com/   about the new congressional districts in Texas being redrawn so that the new seats favor the Democratic party in a Republican state. This follows this post about forced unionism. This follows this previous article about encouraging American energy independence. Judicial gerrymandering‏

We just thought the battle over Texas’ legislative lines was finished!

Attorney General Greg Abbott has asked the US Supreme Court for an emergency stay on the arbitrary maps handed down by a three-judge federal panel in San Antonio right before Thanksgiving.
BLOGGER'S NOTE: CONTACT GREG ABBOTT HERE: greg.abbott@oag.state.tx.us

EmpowerTexans.com “Around Texas” writer Michele Samuelson noted last night that it will be US Supreme Court Justice Antonin Scalia reviewing Mr. Abbott’s request.

As you know, the responsibility for the drawing of representational maps rests with the legislatures of the several states, not federal judges. The federal courts, when only absolutely necessary, should make only the bare minimum of changes to rectify clear violations of law.

Instead, the court re-drew the maps for the Texas House, Texas Senate and US House. One judge dissented from his colleagues' version of the Texas House map, describing as going beyond what is “legal, practical, or fair.”

That's putting it mildly. The maps they ordered are a lesson in judicially-mandated gerrymandering; the radical changes they are imposing on the state’s political landscape is nothing short of shocking.

(Practically, the judicial activism exhibited by these federal district judges has plunged all of us into a new world of election law. Remember, filing for office has already been delayed. When ordering the new maps right before Thanksgiving, they set tomorrow -- Monday, the 28th -- as the new opening for filing. If a stay is granted by the Supreme Court, filing would necessarily be delayed further as yet new maps are prepared.)

State Rep. Larry Taylor, who serves as chairman of the Texas House Republican Caucus, this past week sent a strongly worded letter to the A.G. saying he and other lawmakers are “fully supportive” of fighting the “dramatic overreach” of the federal judges. Taylor described the wholesale re-write as thwarting “the will of Texas voters” and representing a “significant blow” to our “democratic form of government.”

In Michele Samuelson’s words, we today must count on the Supreme Court to force back this “egregious case of judicial activism.”

It's the responsibility of the courts, Attorney General Abbott noted in his request for a stay, "to apply the law, not to make policy."

What liberals have been unsuccessful in achieving at the ballot box in Texas, they have managed to find a federal court willing to force upon us. Using these court-imposed lines without a fight would be a farce and a disgrace, essentially disenfranchising every Texan while altering the state’s policy outcomes for a decade or longer.

Mr. Abbott’s decision to vigorously fight the imposition of the federal judges’ maps is the correct one.

Texas constitutional amendment election‏

A very interesting post from http://www.empowertexas.com/ about the constitutional election in Texas. This follows this post about the about the November 8 election in Ohio. This follows this post about the election in Mississippi and  this post about the election in Kentucky! This follows this previous article about encouraging American energy independence. This is a key issue to prevent money from going to hostile countries such as Iran  and Venezuela. For more that you can do to get involved click HERE and you can read a very interesting book  HERE!

Texas constitutional amendment election‏

Texans are going to polls to consider 10 propositions amending the state’s constitution. The amendments cover everything from water debt to veterans’ property taxes.

You can find our complete listing of the amendments, our take and recommendation, by visiting our website. There, you can also find a handy sample ballot noting our recommended positions.

The Bad

The worst of the amendments are Propositions 2, 3, 4 and 6.

Propositions 2 and 3 would set in place permanent debt – allowing government agencies to issue bonds over and over without ever having to approach the citizens again for a vote. That’s an incredibly irresponsible way for government to treat debt.

Proposition 4, meanwhile, would open the door to Texas’ counties taking private property for the same kind of “economic development” reasons that has sparked so much outrage in cities across the country. We should be curtailing the ability of government to take private property, not increasing it.

Meanwhile, Proposition 7 would allow an El Paso County entity to start levying property taxes. We should be moving away from property taxes, not getting more governments hooked on them.

Finally, Proposition 6 would endanger the long-term viability of the state’s Permanent School Fund. It would allow a larger portion of the fund to be tapped for expenditure in the short-term, meaning fewer dollars would be available to grow the corpus and keep the fund viable into the future.

Neutral

We are neutral on Propositions 8, 9 and 10, but do offer a summary on our website of what supporters and opponents are saying about them.

The Good

Finally, we are supporting Propositions 1 and 5.

Proposition 1 would recognize the sacrifice made by our 100% disabled veterans by granting a property tax exemption to them and their surviving spouses. The fine men and women who serve our nation by defending our liberties, and then find themselves fully disabled as a result, all too often find federal services difficult to access. Providing some property tax relief through Proposition 1 can at least allow Texas to step in where Uncle Sam too often has failed.

Proposition 5 will allow cities and counties to enter into cost-savings interlocal agreements of a year or longer without having to classify them as expenses if they are not. In the past, such agreements had been counted as debt and have a portion of their tax revenues set aside to cover it. But for those agreements that result in cost-savings, the old state of the law got in the way.

Hopefully, Proposition 5 will result in more local government seeking sensible agreements that save money and improve services.

All of us at Texans for Fiscal Responsibility encourage you to utilize the resources of various organizations to study these propositions and their impact on the Lone Star State. And, most importantly, we encourage you to participate in the Nov. 8 constitutional amendment election.

Please tell the Texas Senators about leadership problems and redistricting to reflect the state's conservative voters HERE!

Texas' Leadership Conundrum

By MQSullivan
With Texas' top two elected office-holders eyeing moves to federal office, Texans face the real possibility of our next legislative session being overseen by a governor and lieutenant governor not elected by the people but instead selected by the state’s senate.

With Rick Perry’s presidential bid gaining steam, and David Dewhurst in the race for the US Senate, we could find both men resigning their current offices in late 2012. While not a constitutional crisis, such a scenario creates a leadership conundrum for Texans to thoughtfully consider.

Our state's constitution provides for an orderly transition of power when vacancies occur in the top offices. If the governor resigns his office, the lieutenant governor -- elected statewide, separately from the governor -- moves into the governor's mansion. The senate then picks from among their own a new lieutenant governor.

In the legislatively proscribed order of gubernatorial succession, the president pro tempore of the Senate, Speaker of the House, the Attorney General and the chief judges of the Court of Appeals are all in line to be governor if those proceeding in order were simultaneously unable to serve. Even then, a new lieutenant governor would be picked by the senate.

Let's say both Gov. Perry and Lt. Gov. Dewhurst win their respective federal races. President-elect Perry would likely resign first, to focus on the presidential transition, moving Mr. Dewhurst (Senator-elect, as it were) to the office of the governor.

The state senate would convene to select from among themselves a new lieutenant governor. Once the new lite-guv was sworn in, Mr. Dewhurst could resign and head off to DC. This new lieutenant governor (who just 15 minutes before was a state senator few Texans had heard of) moves up to governor. The senate, still hanging around, would pick yet another new lieutenant governor (also a state senator, who you had probably heard even less about) from the remaining 30 senators.

If such a scenario plays out, it might make voters suddenly pay a little more attention to the senatorial "club" than in the past. By then it’ll be too late, which is why we must begin asking tough questions now.

Why? The senate doing the picking for the new governor and lieutenant governor won't be elected in 2012 and seated in 2013, it will most likely be the current senators. Worse, it will be a lame-duck senate with members who didn't seek re-election or were defeated in the 2012 cycle.

The senate is currently composed of 19 Republicans to 12 Democrats. In practice, it's more like a half-dozen conservatives, a few quasi-conservatives and 19 or more moderates and liberals. (Gerrymandering, incumbency power and voter apathy have conspired to ensure the state senate looks less like Texas, ideologically, than one might presume.)

Nothing stops the senate from populating the offices of governor and lieutenant governor with washed up pols who lost re-election bids, vacated their seats, or are simply out of touch with the state’s electorate. Given the peculiar voting blocs and deal-swapping in the state's senate, the governor and lieutenant governor could well be a moderate Republican or Democrat.

The kind of leadership the senate picks will have immediate consequences. The 2013 legislative session is going to be fiscally trying, perhaps even more difficult than the recently concluded session. Indeed, budget debates in 2013 will make those of 2011 seem almost benign in comparison.

And don’t think lobbyists and Capitol insiders aren’t giddy about the prospect of influencing the selection of a new state leadership more beholden to them than Texas’ taxpayers.

Frankly, many senators would prefer not be asked where they will stand on the question of who will be allowed to ascend. They'd certainly prefer not to provide any straight answers.

Texans cannot afford a “let’s wait and see” attitude from our senators. As voters, we need to gather public commitments -- especially from Republican senators and candidates -- about how they will approach the selection process.

Thanks to redistricting, every single senator will be on the ballot in 2012. Waiting until after the November election to ask them about state leadership won't matter. Make the senators go on the record before getting your support; make them describe how they will vote and publicly commit to picking a sound conservative.

Voters should demand to know, and soon, if their senator plans to let chamber comity and special interests trump the conservative conscience of the Texas majority.

Protecting classrooms in Texas‏

A very interesting post from http://www.empowertexas.com/ about the state's budget battle centering on schools. This follows this post about the Tea Party Patriots summit in Phoenix today and this article about  the recent news about ending the ban on offshore drilling which would encourage American energy independence This is a key issue to prevent money from going to hostile countries such as Iran  and Venezuela. Protecting classrooms in Texas‏

Texas voters clearly expect the legislature to balance the budget without raising taxes, which means responsible spending cuts and prioritization.

Protect The Classroom

But right now, public education bureaucrats are attempting to scare legislators, parents and teachers by threatening the classroom with big cuts.

You’ve probably seen the “shock” headlines about teachers being fired. Superintendents and school board members are essentially saying that they will start the cutting by letting teachers go.

That's irresponsible and reprehensible; the classroom must be protected. Public education exists to educate kids, not employee bureaucrats.

Right now teachers make up barely half the school employees as it is. That’s right: half of all public school employees are not teachers. And, as it happens, half of every public education dollar is spent outside the classroom.

Learn more at our new website, http://www.protecttheclassroom.com/. From there, tell your state legislators to stand firm on cutting the budget and let them know real education savings can be found outside the classroom!

Dr. Z’s Bad Medicine

Meanwhile, some bad budget medicine is being prescribed by State Rep. John Zerwas. The Republican physician spent Wednesday passing out the “use the rainy day fund” pills pushed by the AFL-CIO and other liberals wanting to keep government growing.

Dr. Zerwas says it will “dull the edge” of the budget process. Dull it? Dr. Zerwas said he would spend nearly all of the money -- that's more like an overdose of irresponsibility!

Sorry, Dr. Z., but taxpayers are demanding responsible solutions, not fiscal narcotics, from the Republican supermajority. We want seriously considered budget reductions, not liberal pablum.

That’s why Gov. Rick Perry and most other conservative leaders have said the state’s piggy bank shouldn’t be cracked to pay for recurring spending.

Get Going!

Public employee unions and others are at the Capitol day in and day out, telling legislators to “raise taxes.” It’s an onslaught.

Government goes to those who show up – your voice is needed now more than ever!
